Lizzo granted trademark for "100% that bitch" phrase

Lizzo has been granted the trademark for her "Truth Hurts" lyric "100% that bitch" by the US Patent and Trademark Office more than three years after filing the application.

Back in August 2019 Lizzo filed a trademark application for her "100% that bitch" phrase from her 2017 song "Truth Hurts". Yesterday (2 February) People reported that the US Patent and Trademark Office granted Lizzo the trademark after rejecting the application in 2022.

Lizzo now has exclusive rights to use the phrase on clothing. The statement about the decision read: "Considering the entirety of the record, we find that most consumers would perceive '100% THAT Bitch' used on the goods in the application as associated with Lizzo rather than as a commonplace expression."

A lawyer for the US Patent and Trademark Office previously argued that the phrase was "a message of self-confidence and female empowerment," and didn't "entitle" Lizzo to have "exclusive use of the phrase". Lizzo's lawyers came back with various references of the phrase being used "from 2017 or later," and argued there was "no evidence of use of the term 100% THAT Bitch prior to 2017."

Lizzo, Harry Styles, Steve Lacy, Mary J. Blige, Sam Smith, Kim Petras and more will perform at the 2023 Grammys this Sunday (5 February).
